The stage of collecting evidence is of great importance in that it is the basis on which most cases are based and is necessary to uncover crimes, as evidence is collected by judicial police officers whose specializations and duties vary according to the capacity they have, based on their rank and position in the agency they follow. According to the authority granted to them by law, whether it is a public or private jurisdiction, and whether it is ordinary or exceptional, These are procedures that are initiated against the person of the suspect who is distinguished from the accused and against whom search and investigation procedures are taken within the framework of limits that serve as guarantees approved by Islamic law, which is the first in the field of guarantees of the rights and freedoms of individuals, as well as contemporary positive legislation, including what is contained in human rights declarations. International agreements as international sources of guarantees, then internal laws as internal and national sources of guarantees, in addition to constitutional provisions the principal it included the most important of which are the origine of humain innorces and procedural lagality.
